Terms & Conditions
Our Contract - These are the conditions of the contract between you and Elizabeth and Ernie Bentley, trading as Atholl Brae (“we”). When you book accommodation, a contract is made when booking confirmation and your deposit is received by us (“the Confirmation Date”).
The contract confers on you a right to occupy the flat for a holiday only, and does not confer an “assured tenancy” as detailed in section 12, (sched 4, para 8) of the Housing (Scotland) Act 1988.
Acceptance of Conditions - By making a booking you accept these conditions on behalf of all the members of the party. You also accept responsibility for paying for the account for the whole stay. You must be at least 18 years old to book.
Bookings - Initial bookings can be made by email, telephone or in writing (the “Reservation Date”). A firm booking by email or in writing must be made within 7 days accompanied by the deposit. (Please see below). A Confirmation Note will then be issued by email or in writing by us. (The date this is issued is the “Confirmation Date”). Bookings made four weeks or less before the arrival date must be followed by the full holiday price, to arrive within 7 days of the Reservation Date.
Numbers of guests - The number of occupants must not exceed the number on the booking form.
Deposit - To guarantee a booking - a non-refundable deposit is required within 7 days of the Reservation Date. The deposit for this property is 25% of the full price. This can be made by cheque (payable to E Bentley) or by credit card via Paypal. This deposit will be deducted from the final charge.
Deposit - Parking - A £30.00 deposit is required for the parking permit, if this is required.
Deposit – contingencies – We also require a contingency deposit of £100 per booking, payable with the balance of rental The latter 2 deposits will be refunded within 7 days of vacating, subject to the return of the permit and any reductions for damage or breakages.
Prices vary depending on availability and time of year, and can also be subject to your length of stay. Please read your Confirmation Note once you have received it and check all details are correct.
Payment - The full amount for the holiday must be paid four weeks prior to the Arrival Date. (see Bookings). If full payment is not received four weeks prior to arrival date then it may be considered a cancellation of the booking and in this case we reserve the right to make the property available for booking to other parties. At present, we accept Paypal deposits and cheques.
VAT - At present, VAT is not chargeable.
Arrivals - The flat will be available from 4.00pm on the Arrival Date.
Departures – The flat must be vacated by 11am on the day of departure Keys – We will provide access details once full payment has been cleared.
Towels, Bed-linen, and reasonable use of Gas and Electricity are provided for your use during your stay and included in the charge.
Telephone facilities may be provided at extra cost, on request.
Wire free internet access is available – we cannot guarantee compatibility with your own equipment, however, and you use this equipment at your own risk.
Insurance - Travel Insurance is not included in your package; however, we recommend you take out travel insurance. We do not accept responsibility for loss, damage or injury to any member of your party as consequence of this agreement or the occupancy following thereon.
Cancellations - You must make cancellation directly with us then confirm in writing/ by e-mail. The booking guarantee deposit is non-refundable. The balance of the booking cost charged by us will be refunded on the following basis 21-28 days = 50% of total cost retained, 8-20 days = 75%, 7-0 days = 100% We strongly recommend you take out cancellation insurance.
Security and cleanliness – The hirer undertakes to leave the premises secure when left and will leave the premises in a clean and tidy condition. We reserve the right to charge for an unreasonable amount of cleaning at the end of the hire.
Smoking – Is not permitted within the flat. If this is disregarded, we reserve the right to make an additional charge for extra cleaning.
Pets –We regret animals cannot be accommodated.
Damage to property - In the event that the owners’ property of the flat is deliberately, or negligently, damaged by you or any member of your party, you will be fully liable for the repair or replacement of the property in question.
Unreasonable Behaviour - The hirer undertakes to prevent any member of their party from causing a nuisance or disturbance to other residents or neighbours.
Fire safety regulations do not allow candles or fireworks to be used within this property.
Classification –The flat is a four star self catering establishment, in the terms of Visit Scotland current criteria.
Brochure/Website – We have done our best to ensure that details are accurate; however we do reserve the right to make modifications if necessary.
Unavailability - In the unlikely event that the flat is not available due to circumstances beyond our control we will refund any monies received from you.
Access - We reserve the right of access to the flat at any reasonable time during your stay.
Applicable Law - These terms and conditions, and the contract constituted by them, are governed by and shall be constituted in accordance with the laws of Scotland, and the parties tot his contract hereby prorogate the non-exclusive jurisdiction of the Scottish Courts.
Amendment to Contract - We reserve the right to change, cancel or withdraw any of these terms and conditions or your reservation without entering into communication regarding these changes.
